These Terms of Use govern access to and use of the Astrashine website and its travel discovery, comparison and referral features. Please read them before using the platform.
Operator: Astrashine and Company LTD, a company registered in Kenya. The business operates online, with its business location in Nairobi, Kenya. Contact: info@astrashine.co.ke.
1. About Astrashine
Astrashine is a travel discovery and referral platform. It is designed to help users explore travel-related options and connect with independent travel providers, which may include accommodation, flights, car rentals, yachts, private travel, tours and experiences, and wellness services.
Unless a separate written agreement expressly says otherwise, Astrashine is not the airline, hotel, car rental company, yacht operator, tour operator, insurer or other travel supplier. Astrashine does not itself operate the services offered by independent providers.
2. Acceptance of these terms
By accessing or using Astrashine, you agree to these Terms of Use and our Privacy Notice. If you do not agree, do not use the platform.
If you use Astrashine on behalf of another person or organisation, you confirm that you are authorised to do so.
3. Eligibility and accounts
You must be legally capable of entering into a binding agreement under the laws applicable to you. If you are below the age of legal majority, you may use the platform only with the involvement and authorisation of a parent or legal guardian where required by law.
You must provide accurate account information, keep your login credentials confidential and promptly notify the operator if you suspect that your account has been compromised.
You are responsible for activity carried out through your account except to the extent that applicable law provides otherwise. We may suspend or restrict accounts where reasonably necessary for security, suspected misuse, legal compliance or enforcement of these terms.
4. Platform services and availability
We may provide search tools, travel discovery information, links, account features and referral connections. Features, providers and categories may change, be unavailable or be withdrawn without notice where reasonably necessary.
Search results and displayed information may be incomplete, delayed or unavailable. Unless a feature expressly states otherwise, results are not a confirmed reservation, ticket, booking, quotation or guarantee of availability.
At the date of these terms, Astrashine does not claim to provide a complete live inventory of travel offers or to synchronise bookings made on partner websites with customer accounts.
5. Independent travel providers
When you select a provider or follow a referral link, you may leave Astrashine and interact directly with an independent third party. That provider is responsible for its own services, descriptions, prices, availability, booking process, customer support and contractual obligations.
Before making a booking or payment, review the provider's terms, privacy notice, cancellation and refund policies, travel requirements and any applicable taxes or fees.
A booking made with a provider is a contract between you and that provider, unless a separate written agreement expressly establishes otherwise. Astrashine is not responsible for the provider's performance or failure to perform, subject to rights that cannot legally be excluded.
6. Prices, availability and travel information
Prices, schedules, availability, descriptions and other travel information may change and may be controlled by third-party providers. Any information shown on Astrashine should be independently checked with the provider before you rely on it or make a purchase.
The final price may include taxes, service charges, baggage fees, local fees, exchange-rate differences or other amounts not reflected in an initial search result. The provider's final checkout information and booking confirmation govern the transaction with that provider.
You are responsible for checking passport, visa, health, insurance, entry, transit and other travel requirements relevant to your journey. Astrashine does not provide immigration or legal advice.
7. Affiliate links and commercial relationships
Astrashine may use affiliate or referral links. If you follow one of these links and make a qualifying purchase or booking, Astrashine may receive a commission or other compensation from the provider, at no additional cost to you unless the provider's terms state otherwise.
Affiliate relationships do not make Astrashine the provider of the advertised travel service. A referral link does not guarantee that a provider will accept a booking, honour a price or provide a service.
We will identify material affiliate relationships clearly where required by applicable advertising and consumer-protection laws.
8. Payments, changes, cancellations and refunds
Unless a specific service is expressly offered and sold by Astrashine under separate terms, payments, booking changes, cancellations, refunds and chargebacks are handled by the provider with whom you made the booking.
Contact that provider directly about its booking. Astrashine cannot promise to change, cancel, refund or recover payment for a booking made on a third-party website.
9. Acceptable use
You agree not to:
- Use the platform for unlawful, fraudulent or deceptive purposes.
- Attempt to gain unauthorised access to accounts, systems, databases or administrative functions.
- Interfere with the platform's operation, security or availability.
- Upload or transmit malicious code or attempt to exploit vulnerabilities.
- Use automated scraping, harvesting or bulk extraction without our written permission.
- Misrepresent your identity, submit false information or misuse referral links.
- Infringe intellectual property, privacy or other rights of Astrashine or third parties.
- Use the platform in a way that could damage its reputation or expose users or providers to harm.
10. Intellectual property
Unless otherwise stated, the Astrashine name, branding, website design, original text, graphics and platform materials are owned by or licensed to the operator and are protected by applicable intellectual property laws.
You may use the platform for personal, lawful and non-commercial discovery purposes. You may not copy, modify, distribute, commercially exploit or create derivative works from protected platform materials without prior written permission, except where applicable law permits.
Third-party names, logos, images and provider materials remain the property of their respective owners.
11. User information and privacy
Your use of the platform may involve the collection and processing of account details, search activity, session information and referral click information as explained in our Privacy Notice.
You must not submit information that you are not authorised to provide. Do not submit payment-card information or sensitive travel documents through general platform fields.
12. Disclaimers
To the extent permitted by applicable law, the platform is provided on an "as available" basis. We do not guarantee uninterrupted access, error-free operation, completeness of search results or the accuracy or continued availability of third-party information.
We do not warrant or guarantee the quality, safety, suitability, legality or performance of services supplied by independent providers. Any descriptions or links are provided for discovery and referral purposes and do not constitute an endorsement or guarantee.
Nothing in these terms excludes a warranty, consumer right or protection that cannot lawfully be excluded or limited.
13. Limitation of liability
To the maximum extent permitted by applicable law, the operator will not be liable for indirect or consequential loss, loss of profit, loss of opportunity, loss of data or costs arising from your use of independent provider services or websites.
To the maximum extent permitted by applicable law, the operator's liability arising directly from the provision of the Astrashine platform will be limited to the amount, if any, you paid directly to Astrashine for the relevant platform service during the twelve months preceding the event giving rise to the claim.
These limitations do not apply where liability cannot lawfully be excluded or limited, including liability for fraud, wilful misconduct or other liability that applicable law makes non-excludable.
14. Indemnity
To the extent permitted by applicable law, you agree to be responsible for losses and reasonable costs directly caused by your unlawful use of the platform, your material breach of these terms or your infringement of another person's rights. This provision does not require you to indemnify the operator for the operator's own unlawful conduct or liability that cannot lawfully be shifted to you.
15. Suspension and termination
We may suspend or restrict access where reasonably necessary to protect the platform or its users, investigate suspected misuse, comply with law or enforce these terms. Where appropriate and lawful, we will provide notice and an opportunity to address the issue.
You may stop using Astrashine at any time. Account closure and requests concerning personal information are handled subject to applicable law and our Privacy Notice.
16. Changes to the platform or these terms
We may update the platform and these terms from time to time. The revised terms will be published on this page with an updated date. Where a change materially affects users or requires consent, we will provide additional notice or obtain consent as required by law.
17. Governing law and disputes
These terms are intended to be governed by the laws of Kenya, subject to any mandatory consumer-protection or other laws that apply in your country of residence and cannot lawfully be excluded.
Nothing in this section removes any right you may have to bring a claim before a court or authority that has mandatory jurisdiction under applicable law.
